| Each state has a Workers Compensation law. While each varies in details, the basic thrust of all are the same: employees are compensated for workplace injuries, regardless of fault, in turn for which employers are immune from injury lawsuits by employees.
In some states Workers Compensation benefits are provided entirely by the state. In others, both state funds and private insurance are utilized. In the majority of states, Florida included, the benefits are regulated by the state, but paid entirely through private insurance or self-insurance means.
Regulation of the Workers Compensation law in Florida is by the Division of Workers Compensation within the Department of Financial Services.
Significant penalties are issued to Florida employers who fail to secure Florida Workers Compensation benefits for employees. Stop-work orders & fines will be levied in addition to injunction and assessments against the employer. Employers who try and circumvent the law by going without Workers Compensation will expose their personal assets and other business assets.
